1 General Terms & Conditions
1.1 This site is owned and operated by Cream Business Associates Ltd, T/A Cream Photo Workshops of Gwili House, The Ropewalk, Hakin, Milford Haven SA73 3LW. Company registered in England & Wales, registration number 6042239. 2 The Contract Between Us
2.1 We must receive payment of the whole of the price for the workshop(s) or goods you have requested before your booking/order can be accepted. Once payment has been received by us we will confirm that your booking/order has been accepted by sending you a booking/order confirmation and receipt. Our acceptance of your booking/order brings into existence a legally binding contract between us.
3 Ownership of Rights
3.1 All rights, including copyright, in this website are owned by or licensed to Cream Business Associates Ltd, T/A Cream Photo Workshops. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.
4 Accuracy of Content
4.1 We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all services and goods have been fairly described. However, bookings/orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Any duration, weights, dimensions and capacities given about the goods/services are approximate only.
5 Damage to Your Computer
5.1 We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
6 Cancellation Rights
6.1 Under the Distance Selling Regulations you have the legal right to cancel your booking/order within seven days of receipt of your booking confirmation/goods (with the exception of any made to order items). You do not need to give us any reason for canceling your contract nor will you have to pay any penalty. However, you will need to notify us if you wish to cancel your contract.
6.2 Without prejudice to 6.1 above, if you wish to cancel your booking(s)/order(s) you understand that a refund less a £25 administration fee will be re-credited to your account.
6.3 In the event that you are the only person booked on a group workshop we reserve the right to offer you a three-hour one-to-one as an alternative at no additional charge. Alternatively subject to space you may switch to a future workshop or have a full refund.
By making a booking for a Cream Photo One To One Workshop you are entering into an agreement as follows: If you wish to cancel your booking you must notify us by email no later than 24 hours prior to the date agreed between us. In the case of a booking paid for in full or in part by gift voucher, we will issue a credit for the gift voucher value. We do not give refund/s for cancellation of a booking/s with less than 24 hours notification given to us prior to the agreed date.
6.4 You cannot cancel your contract if the goods you have ordered are newspapers or magazines or if you have taken any audio or video recording or computer software out of the sealed package in which it was delivered to you.
6.5 If you have received the goods before you cancel your contract then [unless, under clause 6.3, for which you do not have a right to cancel] you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.
6.6 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
6.7 You will be re-credited for the costs incurred in returning faulty or unsatisfactory goods.
6.8 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.
7 Gift Vouchers
7.1 Cream Photo Workshops Gift Vouchers can be redeemed against any of our photography workshops, one-to-one training, tutor supported Distance Leaning and self-study eBooks.
7.2 Our Gift Vouchers are valid for twelve months from the date of purchase.
7.3 Our products and services should be booked in the usual way while stating that you are using a gift voucher in part or full payment.
7.4 At the time of making a booking/placing an order you will be asked to quote the voucher value and reference number.
7.5 Cream Photo Workshops cannot guarantee the availability of any workshop at any venue.
7.6 Cream Photo Workshops Gift Vouchers are not redeemable for cash.
8 Notices
8.1 Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address Cream Photo Workshops, Gwili House, The Ropewalk, Hakin, Milford Haven SA73 3LW and all notices from us to you will be in writing or email to the addresses you have provided on the order form.
9 Changes to Legal Notices
9.1 We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
10 Insurance
10.1 It is advisable that you have insurance for your own camera and equipment. We are not responsible for any damage incurred to your photographic equipment or belongings when you attend our Photography Workshops.
11 Trip Cancellation Insurance
11.1 We recommend that you purchase trip cancellation insurance. We are not able to vary from our stated refund policy regardless of your situation.
12 Young People Under The Age of 16.
12.1 Persons under the age of 16’s must be accompanied by an adult throughout who is also booked on the course.
13 Force Majeure or Act of God
13.1 We shall not be liable for any default (or deemed to be in breach of contract) by reason of any delay due to circumstances beyond our control.
14 Own Risk
14.1 I understand that during my training with Cream Photo Workshops I may visit a variety of locations. I understand that during the full duration of the course, and when I am visiting, or travelling to or from these locations, I do so entirely at my own personal risk and take full responsibility for my actions.
15 Entire Agreement
15.1 These terms and conditions together with our invoice and booking form set out the whole of our agreement relating to the supply of goods and services to you by us. Nothing said by any sales person, agent, employee, director or other representative on our behalf should be understood as a variation or an addition to these terms and conditions or as an authorised representation about the nature and the quality of any goods or services provided under this contract. Save for fraud or fraudulent representation we shall have no liability for any such representation being untrue or misleading.
16 Invalidity
16.1 If any part of these terms and conditions are unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
17 Law and Jurisdiction
17.1 The validity, construction and performance of this contract shall be governed by English law and shall be subject to the exclusive jurisdiction of the English Courts to which you and we submit.
18 Third Parties
18.1 For the purpose of the Contracts (Rights of Third Parties) Act 1999 and notwithstanding any other provision of this contract this is not intended to, and does not give any person who is not a party to it any right to enforce any of its provisions.
19 Privacy Statement
19.1 Cream Business Associates Ltd, T/A Cream Photo Workshops are committed to protecting the privacy of anyone using our site and the confidentiality of any information that you provide us with. The purpose of this statement is to set out how we use any personal information that we may obtain from you.
19.2 In general you can visit our website without telling us who you are and without revealing any information about yourself. If, however, you use our site you will need to register and you will be asked to provide certain information such as your contact details. We will store this data and hold it on computer or otherwise.
19.3 We may use information that you provide:
(a) To register you with our website and to administer it.
(b) For assessment and analysis e.g. marketing, customer and product analysis, to enable us to review, develop and improve our services.
(c) To contact you with information of future courses and products that we may offer.
20 Cookies
20.1 There is a technology called “cookies” which may be used by us to provide you with, for example, customised information from our website. A cookie is an element of data that a website can send to your browser which may then store it on your system. If you wish, you can usually adjust your browser so that your computer does not accept cookies. Please remember cookies do not contain confidential information such as your home address, telephone number or credit card details. We do not exchange cookies with any third party websites or external data suppliers.
21 Security
21.1 We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unless this is due to our negligence or wilful default.
22 General
22.1 You have the right to see personal data (as defined under the Data Protection Act) that we keep about you upon receipt of a written request and payment of a fee of £25. Any request should be sent to: Cream Photo Workshops, Gwili House, The Ropewalk, Hakin, Milford Haven SA73 3LW.
23 Declaration
23.1 I confirm that these terms and conditions were brought to my attention prior to payment of booking fee and confirm I have read, understand and accept these terms and conditions. I understand and accept that Cream Business Associates Limited T/A Cream Photo Workshops, their partners, suppliers, officers, agents, photographers and tutors will endeavour to provide a service as fully as possible. By placing an order/booking I agree to these conditions.
